1. Acceptance of Terms

By accessing or using Listing Compliance Shield ("Service"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our Service. We reserve the right to modify these terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

Listing Compliance Shield provides a listing compliance scanning service that helps Etsy sellers identify potential policy violations in their listings. Our Service includes:

  • Scanning listing titles, descriptions, and tags for potential trademark issues
  • Identifying prohibited items and policy violations
  • Providing recommendations for compliance improvements
  • Generating appeal letters for suspended listings (Pro and Business plans)

3. User Accounts

To use our Service, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Be responsible for all activities under your account

You may register using email/password or through Google authentication. You must be at least 18 years old to create an account.

4. Subscription and Payments

Plans and Pricing

We offer the following subscription plans:

  • Free - 5 scans per month, basic compliance checks
  • Pro - 150 scans per month, appeal letter generator
  • Business - 500 scans per month, appeal letter generator

Billing

Paid subscriptions are billed monthly in advance. Payment processing is handled securely by Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis until you cancel.

Cancellation and Refunds

You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to your paid features until the end of your current billing period. We do not provide refunds for partial months of service.

Scan Limits

Each plan includes a monthly allocation of scans. Unused scans do not roll over to the next month. If you exceed your scan limit, you will need to wait until your next billing cycle or upgrade to a higher plan.

5. Acceptable Use

You agree not to use our Service to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights of others
  • Submit false or misleading information
  • Attempt to circumvent scan limits or abuse the Service
  • Reverse engineer, decompile, or disassemble the Service
  • Use automated tools to access the Service without authorization
  • Interfere with or disrupt the Service or servers

6. Intellectual Property

The Service, including its design, features, and content, is owned by Listing Compliance Shield and protected by intellectual property laws. You retain ownership of any listing content you submit for scanning. By using our Service, you grant us a limited license to process your content solely for the purpose of providing the Service.

7. AI-Generated Content

Our Service uses artificial intelligence (Claude by Anthropic) to analyze listings and generate appeal letters. You acknowledge and agree that:

  • AI-generated content is provided as a starting point and may require editing
  • You are responsible for reviewing and verifying all AI-generated content before use
  • We do not guarantee the accuracy, completeness, or effectiveness of AI-generated content
  • AI analysis results are recommendations, not legal or professional advice

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT:

  • The Service will be uninterrupted or error-free
  • Scan results will identify all potential policy violations
  • Following our recommendations will prevent listing suspensions
  • Appeal letters will result in reinstatement of suspended listings

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LISTING COMPLIANCE SHIELD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Third-Party Disclaimer

LISTING COMPLIANCE SHIELD IS NOT AFFILIATED WITH, ENDORSED BY, OR SPONSORED BY ETSY, INC.

"Etsy" is a trademark of Etsy, Inc. Our Service is an independent tool designed to help sellers comply with Etsy's policies. We do not have access to Etsy's internal systems or policies beyond what is publicly available. Etsy's policies may change at any time, and we cannot guarantee that our Service reflects the most current policy requirements.

11. Indemnification

You agree to indemnify, defend, and hold harmless Listing Compliance Shield and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service will immediately cease. You may also delete your account at any time through your account settings.

13. Changes to Terms

We may update these Terms and Conditions from time to time. We will notify you of material changes by posting the updated terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the new terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Listing Compliance Shield operates, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
